These terms and conditions include general terms and conditions for use of this site and terms and conditions relating to the services provided by Vivara. The rights of cancellation and refund and any limitation expressed in these terms and conditions do not affect your statutory rights as a consumer.
Please read these terms and conditions carefully. By using this site and purchasing any of any services from Vivara you will be agreeing to the terms and conditions below.
CLASSES
All class bookings must be made via the online booking system. Classes operate on a first-come, first-served basis and can be booked up to 90 days in advance. Payment for classes is taken at the time of booking. All clients agree to our 24 hour notice policy when cancelling and/or rescheduling. If you have booked a class, but miss it or cancel with less than 24 hours' notice, you will be charged. Please always notify us of a cancellation by making the change in your bookings, even if less than 24 hours notice as if we can fill your space a refund may be possible at the discretion of Vivara.
There is waiting list of 3 people maximum per class. If you add yourself to a waiting list then you will be informed by email if a space becomes available and automatically booked into that class. You will receive 2 notifications to accept the reservation before the available slot is offered to the next person on the waiting list.
Block passes are non transferable and refunds will not be provided. Class packages expire after a 4 month period; please ensure you complete your sessions within this time frame as extensions are not possible.
If you have not previously attended Vivara for 1:1 Pilates or Physiotherapy intervention a health screening questionnaire will need to be completed prior to attending your first Pilates class. If there are any concerns regarding your ability to complete the class you will be contacted. Vivara are highly trained in exercise prescription and injury prevention. Whilst every step is taken to minimise injury risk we cannot guarantee no risk through exercise.
If you join a group session without completing an initial 1:1 session you must complete a waiver to confirm you agree to exercise appropriately and consciously of your own capacity. Vivara is not responsible for any injuries or discomfort as a result of joining group classes. By agreeing to our terms and conditions you accept that no action will be taken against Vivara should injury occur. Clients must wear appropriate attire and use equipment at their own discression.
APPOINTMENTS
Appointments are available to book online up until 1 hour before their start time. We are unable to guarantee any bookings until they are booked and completed online. We are unable to reserve slots and another client may book your preferred slot if they complete before you. Client's must keep their physiotherapist up to date with medical information. When booking any appointment you are consenting to an appropriate physical assessment and/or recommended treatment which may include manual therapy unless otherwise specified. Clients can withdraw consent to assessment and/or treatment at any time.
PRIVATE MEDICAL INSURANCE
We are recognised with all major health insurance providers. Clients must obtain prior authorisation from their provider before their first appointment. Non-BUPA/AXA clients must pay upfront and can request a receipt for reimbursement. BUPA & AXA patients can book directly online or via email. Clients must provide membership and authorisation details before treatment. Any excess on policies must be paid directly to Vivara. Private medical insurance covers Physiotherapy sessions only.
CANCELLATION POLICY
A 24 hour cancellation policy applies to all classes and to all 1:1 sessions and physiotherapy appointments. Cancellations made before these times can be refunded. Late cancellations may not be refunded if the appointment was not filled.
Block payments for packages/classes are non-transferable and non-refundable. All packages have a 4 month expiry period.
LIABILITY
Participation in any class, service or online program is at the client's own risk. Clients confirm they are fit for participation and will follow instructions accurately. Vivara is not liable for personal property loss or damages on site.
DATA PROTECTION
When booking with Vivara clients are expressly consenting to Vivara having authority to store data in accordance with the Data Protection act 2018. This will include client's identity, contact details, past medical history and clinical records. This information will be stored for 8 years after the last treatment for adults and until the clients 25th birthday for children as per best practice guidelines for health records.
By using our website and booking facilities you accept the inherent security implications of dealing online and will not hold Vivara responsible for any breach of security unless such breach has been caused by Vivara’s negligence.
